Crash Compass – a brand of SW-Service & Consulting GmbH

§1 Scope of Application
These General Terms and Conditions apply to the use of the referral service Crash Compass (hereinafter referred to as “Crash Compass”) provided by SW-Service & Consulting GmbH, Frankfurter Straße 76, 35578 Wetzlar (hereinafter referred to as the “Provider”).
Crash Compass offers a free referral service, connecting private individuals and companies in Germany with independent vehicle appraisers, specialist repair shops, and legal professionals.

§2 Services Provided by the Provider
(1) Crash Compass exclusively offers the free referral of services.
(2) The Provider does not perform any appraisal, repair, or legal services itself.
(3) Crash Compass establishes contact between the user and a partner (appraiser, repair shop, or lawyer) without exerting any influence over the partner’s fulfillment of the contract.

§3 Conclusion of Contract
(1) By submitting a contact form via the Crash Compass website, the user commissions the Provider to refer a suitable partner.
(2) A contract for the specific service (e.g., appraisal, repair, or legal consultation) is concluded solely between the user and the respective partner.

§4 Costs
(1) Use of the Crash Compass referral service is free of charge for the user.
(2) Crash Compass receives compensation from partner companies for successful referrals.

§5 Disclaimer of Liability
(1) Crash Compass accepts no liability for the type, scope, quality, or outcome of the services provided by partner companies.
(2) Any claims arising from poor performance or breach of duty must be asserted directly against the respective partner.
(3) The Provider disclaims liability for minor negligent breaches of duty, provided that no essential contractual obligations are affected.

§6 Data Protection
(1) Crash Compass collects, processes, and uses personal data solely in accordance with applicable data protection laws and its privacy policy.
(2) By submitting the contact form, the user consents to the transfer of their contact details to the partner companies.

§7 Right of Withdrawal
Consumers generally have a right of withdrawal in accordance with statutory regulations.
Detailed information can be found in the separate Right of Withdrawal Notice on the Crash Compass website.

§8 Final Provisions
(1) The law of the Federal Republic of Germany shall apply.
(2) The place of jurisdiction for all disputes arising from this contractual relationship, where legally permissible, shall be the registered office of the Provider.
(3) If any provision of these Terms and Conditions is or becomes invalid, the validity of the remaining provisions shall remain unaffected.
